ARTICLE 1 -
Scope
These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by Filles en Carton Ecommerce - FZCO ("the Seller") to consumers and non-professional buyers ("the Clients"), wishing to acquire the products offered for sale by the Seller ("the Products") on the website
They notably specify the conditions of ordering, payment, delivery, and management of potential returns of Products ordered by Clients. These Terms and Conditions may be supplemented by special conditions, set out on the website, before any transaction with the Client. They are accessible at any time on the website and shall prevail, if applicable, over any other contradictory document. As these Terms and Conditions may be subject to subsequent modifications, the version applicable to the Client's purchase is the one in force on the website at the date the order is placed. Validation of the order by the Client constitutes acceptance without restriction or reservation of these Terms and Conditions.
The Client acknowledges having the required capacity to contract and acquire the offered Products.
ARTICLE 2 -
Products offered for sale
The Products offered for sale are those appearing on the website and indicated as sold and shipped by Filles en Carton Ecommerce - FZCO. The main characteristics of the Products are described as accurately as possible. The Client is required to read them before placing any order. The choice and purchase of a Product is the sole responsibility of the Client. Photographs and illustrations presented on the site are non-contractual.
Products are offered for sale for France, Belgium, the European Union, and the rest of the world, subject to logistical feasibility.
In the event of delivery outside metropolitan France, additional delivery costs, duties, and taxes may apply and are entirely the responsibility of the Client.
The Seller reserves the right to cancel any order in the event of stock depletion or impossibility of replenishment.

ARTICLE 4 -
Orders
It is the Client's responsibility to select the Products they wish to order on the site, according to the following procedures: product selection, adding to cart, cart validation, entering delivery and billing information, and final validation of the order after acceptance of these Terms and Conditions and online payment. The contract is concluded upon confirmation of the order by the Seller, materialized by sending a confirmation email to the Client.
Any order placed on the site constitutes the formation of a distance contract concluded between the Client and the Seller.
The Seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute relating to the payment of a previous order.
ARTICLE 5 -
Prices
Products are supplied at the current rates appearing on the site when the order is registered by the Seller.
Prices are expressed in Euros, all taxes included (VAT), unless otherwise stated. Any delivery costs are invoiced in addition, according to the conditions indicated on the site and calculated prior to the validation of the order by the Client.
The Seller reserves the right to modify its prices at any time, but Products will be invoiced on the basis of the rates in force at the time of order validation.
ARTICLE 6 -
Payment terms
The price is payable in full on the day the order is placed by the Client, via secure payment methods, according to the procedures specified on the site. Payments made by the Client will only be considered final after effective collection of the sums due by the Seller.
The Seller shall not be obliged to proceed with the delivery of the Products ordered by the Client if the latter does not pay the full price under the conditions indicated above.
ARTICLE 7 -
Delivery
Products ordered by the Client and available will be shipped within a period of two (2) to four (4) business days from the validation of the order.
Products are shipped from the logistics warehouse located in France: Logisseo – Filles en Carton 28-30 boulevard Gaston Birgé 49100 ANGERS – FRANCE
The indicated delivery times are given as an indication and may vary according to the chosen carrier.
The Seller cannot be held responsible for consequences due to a delivery delay attributable to the carrier or a case of force majeure.
ARTICLE 8 -
Transfer of Ownership - Transfer of Risks
The transfer of ownership of the Products to the Client will only be realized after full payment of the price by the latter, regardless of the delivery date of the Products.
The transfer of risks of loss and deterioration will be realized upon delivery of the Products to the Client.
ARTICLE 9 -
Right of Withdrawal
In accordance with current legal provisions, the Client has a period of fourteen (14) days from the receipt of the Products to exercise their right of withdrawal, without having to justify reasons or pay any penalty.
Products must be returned in their original and complete condition (packaging, accessories, instructions, etc.) allowing them to be re-marketed as new, accompanied by the purchase invoice.
Damaged, soiled, or incomplete Products will not be accepted. Returns must be made to the following address:

The refund will be made within fourteen (14) days from the receipt by the Seller of the Products returned by the Client under the conditions provided above.
ARTICLE 10 -
Seller's Liability - Warranty
Products provided by the Seller benefit automatically and without additional payment, in accordance with legal provisions, from:
The legal warranty of conformity,
The legal warranty against hidden defects resulting from a material, design, or manufacturing defect affecting the delivered Products and making them unfit for use. The Seller cannot be held liable in the event of misuse, use for professional purposes, negligence, or lack of maintenance on the part of the Client.
ARTICLE 11 -
Pre-contractual Information
The Client acknowledges having received communication, prior to the conclusion of the contract, in a legible and understandable manner, of these Terms and Conditions and all legal information, notably:
The essential characteristics of the Product,
The price of the Product,
Delivery times,
Information relating to the Seller's identity, postal, telephone, and electronic contact details,
Information relating to the right of withdrawal.
ARTICLE 12 -
Intellectual Property
The content of the Website (text, images, graphic design, logo, etc.) is the exclusive property of FILLES EN CARTON ECOMMERCE - FZCO.
It is protected by international intellectual property and copyright laws in force in France and the United Arab Emirates.
Any total or partial reproduction, representation, modification, or adaptation is strictly prohibited without the prior written authorization of the Seller.
ARTICLE 13 -
Force majeure
The Seller shall not be held liable for any failure to perform its obligations due to a Force Majeure event (natural disasters, strikes, fires, pandemics, disruptions of transport or telecommunications networks, or governmental decisions).
Contractual obligations will be suspended for the duration of such event.
ARTICLE 14 -
Applicable Law - Language
These Terms and Conditions and the transactions resulting therefrom are governed by the laws in force in the Emirate of Dubai and the federal laws of the United Arab Emirates.
However, this application shall not deprive the Client residing in the European Union of the protection afforded by the mandatory provisions (Consumer Law) of their own country of residence.
These Terms are written in French. In the event of translation, only the French version shall prevail in the event of a dispute.
ARTICLE 15 -
Disputes
In the event of a dispute, the Client is invited to contact the Seller at [email protected] to seek an amicable solution.
Failing an amicable settlement, the Client is informed that they may use the Online Dispute Resolution (ODR) platform provided by the European Commission at the following address:
Any dispute that cannot be resolved amicably shall be brought before the competent courts of the Emirate of Dubai or, if the Client is a consumer residing in the European Union, before the courts of their place of habitual residence.
ARTICLE 16 –
Personal Data Protection
The Seller processes the personal data of Clients for the management of orders and the customer relationship. In accordance with the GDPR, the Client has a right of access, rectification, and deletion of their data.

APPENDIX 1 -
Provisions relating to Legal Warranties
The Seller guarantees the conformity of the Products with the contract and warrants against hidden defects, in accordance with the mandatory legal provisions of the Customer's country of residence.
For any Product presenting a lack of conformity or a latent defect existing at the time of delivery, the Customer has a period of two years to take action.
The Customer may choose between the repair or replacement of the Product, subject to the cost conditions provided by applicable law.
These legal warranties apply independently of any optional commercial warranty.
